Buyer Policy

 

Effective Date: August 19th, 2025

This Buyer Policy outlines the rights, responsibilities, protections, and limitations associated with purchasing materials and equipment on the Construction Marketplace platform.

1. Buyer Eligibility & Account Responsibilities

  • Only registered users may make purchases.
  • Buyers must provide accurate contact, billing, and delivery information.
  • Buyers are responsible for maintaining the confidentiality of their account credentials.

2. Placing Orders

  • Buyers may purchase items through the “,Add to Cart” feature and then check out and pay for the item(s).
  • Orders are considered binding once payment is submitted.
  • Buyers are responsible to review all listing details, images, and specifications before purchasing.
  • The buyer can select “Make an Offer”, in which case a negotiation process will be initiated. Communications will come in the form of an email of which must be responded to in a timely manner or the offer will be automatically declined.

3. No Warranty by Platform

  • Construction Marketplace does not offer any warranties, guarantees, or assurances on listed items.
  • All items are sold “AS-IS” unless otherwise stated.
  • Buyers assume full responsibility for verifying item condition, suitability, and safety compliance immediately upon receipt of purchase.

4. OEM or Manufacturer Warranties

  • Some new or unused surplus items may still carry an original manufacturer’s warranty.
  • Buyers are responsible for verifying the applicability of any OEM warranty prior to purchase.
  • The platform is not responsible for facilitating or validating manufacturer claims.

5. Payment Process

  • Accepted payment methods: Credit/Debit Card, PayPal, ACH Bank Transfer.

Buyers are responsible for all applicable sales tax, credit card processing fees, wire transfer fees, and any other charges or costs not included in the stated price of the products.

  • Payments are processed securely and held in escrow until delivery is confirmed.
  • Buyers are prohibited from engaging in unauthorized chargebacks and must resolve issues through the platform.

6. Shipping, Delivery & Inspection

  • Buyer is responsible for any and all shipping arrangements and costs unless pre-approved in writing otherwise.
  • Shipping fees are calculated at checkout.
  • Buyer’s ship to address must be located within the continental United States
  • Buyers must inspect items upon delivery and report damage or issues within 7 business days.

7. Returns, Refunds & Resolution

  • Buyers may request a return or refund only for the following reasons:
    • Item is significantly not as described
  • Requests must be submitted through the Resolution Center with photos and documentation.
  • Change-of-mind, incorrect fitment,ordered in error, or misapplication are not valid reasons for returns.
  • Buyers are responsible for any handling and managing any shipping damage.  claims filing with the shipping company they hired.
  • It is recommended that you include shipping insurance along with your shipment(s).

8. Prohibited Buyer Conduct

  • Buyers may not:
    • Submit fraudulent claims
    • Attempt to bypass the platform or transact off-site
    • Harass or abuse sellers or support staff
    • Engage in abusive return activity
  • Violations may result in suspension, removal, or legal action.

9. Safety and Compliance Acknowledgment

  • The buyer affirms they will inspect and, if necessary, re-certify items before use.
  • Seller is not responsible or to be held liable for any product use infractions resulting in injury or any other incidents.
  • Buyer is responsible for ensuring compliance with any applicable OSHA, ANSI, or local standards.
  • Heavy equipment purchasers must ensure proper licensing and training for use.

10. Technical Support & Disputes

  • For transaction issues, use the Resolution Center first by contacting us at admin@constructionmarketplace.net
  • Most cases are resolved within 5 business days.
  • For unresolved disputes, the matter may proceed to arbitration as outlined in the Terms of Use.

Seller Policy

This Seller Policy outlines the terms, responsibilities, and expectations for all individuals or businesses (“Sellers”) who list, market, or sell goods through Constructionmarketplace.net (the “Marketplace”). By using the Marketplace as a Seller, you agree to comply with this policy, our Terms of Use, and any additional Marketplace rules, policies, or procedures we publish.

1. Eligibility to Sell

To list items on the Marketplace, you must:

  • Be at least 18 years of age or a legally registered business entity.
  • Have the legal right to sell the listed items.
  • Seller(s) and items must be located within the continental United States.
  • Maintain accurate business and tax information (e.g., W-9, EIN, resale certificate where applicable).
  • Comply with all local, state, and federal laws.

2. Listing Requirements

All listings must:

  • Clearly describe the item’s condition (e.g., new, used, surplus, refurbished), using the provided template.
  • Include a minimum of three (3) accurate images, specifications, brand, model numbers, and any known defects or irregularities.
  • Include any cutsheets, manuals or additional information such as warranties, usage consideration and any application bulletins that you have. These items are preferred but optional.
  • State whether any manufacturer (OEM) warranties are still valid or transferable.
  • Include any applicable certifications (e.g., UL listing, OSHA compliance, Material Safety Data Sheets (MSDS), etc.

Prohibited Listings includes:

  • Counterfeit or stolen goods.
  • Recalled or non-compliant materials or equipment.
  • Hazardous materials unless legally authorized and properly labeled.
  • Any vitamins, minerals, pharmaceutical products and their related manufacturing equipment, or any products governed and regulated by the FDA and or DEA.

3. Product Condition Guidelines

Sellers must adhere to the following condition categories when listing items:

  • New: Unused, unopened, and in original packaging.
  • Surplus: Unused, but may be aged stock, open-box, or repackaged.
  • Used: Previously installed, operated, or handled; must disclose wear, testing status, and serviceability and must state the condition of the item(s) as Excellent, Good or Poor.
  • For Parts/Salvage: Not operational; may be used for components or recycling only.

4. Pricing and Fees

  • Sellers set their own prices but must consider market relevance and item condition and must respond to offers and counteroffers within 2 business days (48 hours).

5. Fulfillment, Shipping, and Handling

  • Sellers are responsible for timely fulfillment, safe packaging, and providing valid tracking information where applicable.
  • Shipping timelines must be clearly stated. Delays must be communicated immediately via email at: admin@constructionmarketplace.net.
  • Items damaged in transit due to inadequate packaging may result in the Seller being liable for refunds.

6. No Marketplace Warranty

The Marketplace does not offer any warranties on items sold. Sellers may:

  • Offer their own warranty directly (optional).
  • Indicate whether an OEM warranty is available (Seller must provide documentation if requested).

IMPORTANT: By listing on the Marketplace, you acknowledge that you (Seller), are solely responsible for verifying warranty status directly with the manufacturer or OEM.

7. Returns and Disputes

  • Each Seller must clearly outline their return policy.
  • If no return policy is stated, the default is “Final Sale – No Returns” unless otherwise required by law.
  • In case of a dispute, the Marketplace may mediate in good faith but is not liable for the outcome. Sellers are expected to cooperate professionally and in a timely manner.

8. Fraud, Misrepresentation, and Listing Violations

The following may result in suspension or permanent removal from the Marketplace:

  • Misrepresenting item condition or warranty status.
  • Listing illegal, counterfeit or unauthorized goods.
  • Repeated customer complaints or failure to resolve disputes.
  • Severe or consistent delays in preparing products for shipment according to the stated guidelines.
  • Attempting to circumvent Marketplace fees or conduct off-platform transactions.

9. Seller Conduct and Reputation

Sellers are expected to:

  • Communicate promptly and respectfully with the Marketplace administration.
  • Maintain a positive sales history and low return rate.
  • Avoid canceling orders except where necessary (e.g., inventory error).

Your Seller performance will be monitored via the Marketplace analytics in these areas:

  • Order accuracy
  • On-time shipping rate
  • Dispute resolution rate
  • Customer feedback and ratings

10. Indemnification

Sellers agree to indemnify and hold harmless the Construction Marketplace, its affiliates, officers, and employees from any claims, damages, losses, or liabilities arising out of:

  • Misrepresented listings
  • Warranty disputes
  • Defective products
  • Buyer misrepresentation, user injury, product misuse by the buyer or any transactional discrepancies.
  • Non-compliance with applicable laws

11. Termination of Seller Privileges

Constructionmarketplace.net reserves the right to suspend or terminate Seller accounts at its sole discretion, with or without notice, including but not limited to:

  • Policy violations
  • Legal non-compliance
  • Fraudulent activity
  • Harm to the Marketplace’s reputation

12. Policy Updates

This Seller Policy may be updated from time to time. Sellers will be notified of material changes via email or platform notification. Continued use of the Marketplace constitutes acceptance of the revised terms.

Shipping & Returns Policy

This Shipping & Returns Policy governs the fulfillment, delivery, acceptance, and potential return of goods purchased through ConstructionMarketplace.net (“Marketplace”). Buyers and Sellers are expected to understand and comply with these guidelines to ensure a fair and professional experience.

1. Shipping & Delivery Standards

For Sellers:

  • Sellers are responsible for packaging and shipping items in a safe, secure, and timely manner.
  • All shipments must include:
    • A valid tracking number (where applicable)
    • Accurate shipping labels
    • Proper protective packaging based on the item’s nature (e.g., crating, palletizing, shrink-wrap for heavy machinery or large parts)
  • Estimated shipping timeframes must be disclosed in the listing or upon sale confirmation.
  • Any delay or disruption must be promptly communicated to the Marketplace via an email to: admin@constructionmarketplace.net.

For Buyers:

  • Buyers must ensure someone is available to receive shipments during normal business hours or clearly state the days and hours restricted for delivery via email at: admin@constructionmarketplace.net
  • Buyer is responsible for any offloading arrangements unless otherwise agreed upon.
  • Buyer is responsible for completing the Freight information form prior to completing the sale.
  • If goods arrive damaged, missing, or inconsistent with the listing, Buyer must notify both the Seller and Constructionmarketplace.net within 2 business days of delivery (see Section 3).

2. Acknowledgement of Receipt & Inspection Period

All Buyers are required to complete the following upon delivery:

Important:
Failure to acknowledge receipt or report any discrepancies within 2 business days will be deemed acceptance of goods in satisfactory condition, and may limit any eligibility for dispute, return, or refund.

3. Damaged, Incomplete, or Misrepresented Goods

If the item arrives:

  • Damaged in transit
  • Substantially different from the listing description
  • Missing components disclosed as included

The Buyer must:

  • Report the issue to their shipping company or if using another entity for shipping, to that entity within 2 business days of delivery.
  • Notify the Marketplace at: admin@constructionmarketplace.net
  • Include photos of the item(s), packaging, damage, and relevant defects.
  • Retain all packaging and shipping documentation.

Sellers are expected to respond promptly and work in good faith to resolve the issue with the Marketplace Administrator they are assigned. The Marketplace may, at its sole discretion, assist in dispute resolution but is not liable for the condition, fitness, or function of any item sold, nor is responsible for any costs incurred regarding a dispute resolution..

4. Return Policy

Marketplace-Wide Defaults:

  • By default, all sales are final and non-returnable, unless otherwise stated in the Seller’s individual return policy.
  • The Marketplace does not offer any warranty or guarantee, expressed or implied, beyond the original listing terms.

Exceptions:

  • Sellers may voluntarily offer a return policy. If so, the return terms must be clearly stated in the listing.
  • If a Seller offers returns, Buyers are responsible for:
    • Return shipping costs (unless agreed otherwise)
    • Returning the item in the same condition it was received
    • Providing proof of condition with pictures sent to: admin@constructionmarketplace.net and shipment back to the Seller.

Returned items may be subject to restocking or inspection fees, at the Seller’s discretion.

5. OEM Warranties

Some goods may be eligible for original equipment manufacturer (OEM) warranties. The Marketplace makes no guarantee that a manufacturer warranty applies or is transferable. Buyers must:

  • Inquire directly with the manufacturer if warranty eligibility is a condition of their purchase.
  • Request supporting documentation from the Seller before purchasing if warranty status is material to their buying decision.

6. Disputes & Resolution

All parties are expected to act in good faith. In the event of a dispute:

  • The Marketplace will review evidence submitted by both Buyer and Seller.
  • The decision to offer a refund, facilitate a return, or take other action rests solely with the Seller unless legally obligated otherwise.
  • The Marketplace is not an insurer or guarantor of any item or transaction.
  • The Marketplace cannot, and will not be held legally or financially responsible for any disputes arising between the buyer, seller or any third-parties, including but not limited to logistics companies, investors, countersigned, consignors or any financial institute with an interest in items(s) as collateral for any purpose.

7. Freight & Specialized Shipping

For large, heavy, or industrial goods requiring LTL, FTL, flatbed, or freight services, additional terms may apply:

  • It is the Buyer’s responsibility to coordinate unloading at the destination unless otherwise specified by utilizing the freight template form located here: (link).
  • If freight is damaged upon arrival, the Buyer must note this on the Bill of Lading (BOL) and immediately notify the freight carrier first and then the Marketplace here: admin@constructionmarketplace.net
  • Concealed damage claims must be submitted within 48 hours of receipt.

8. Policy Changes

Constructionmarketplace.net reserves the right to update or modify this policy at any time. Updates will be communicated through the platform. Continued use of the Marketplace signifies acceptance of the latest version of this policy.

By using our Marketplace, you acknowledge and agree to the following warranty terms and disclaimers:

1. No Warranty by the Marketplace

ALL ITEMS LISTED AND SOLD THROUGH THE MARKETPLACE ARE PROVIDED ON AN “AS IS,” “WHERE IS,” AND “AS AVAILABLE” BASIS. Constructionmarketplace.net MAKES NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • The merchantability of the item,
  • The fitness for a particular purpose,
  • The accuracy or completeness of any listing,
  • The title or lawful right to sell any item,
  • Or that the item will meet the Buyer’s expectations, needs, or specifications.

2. Seller Responsibility

Each item listed on the Marketplace is sold by an independent third-party Seller. The Seller is solely responsible for:

  • Describing the item accurately,
  • Disclosing known defects, prior use, and condition,
  • Confirming whether any manufacturer (OEM) warranty applies,
  • Handling any return, dispute, or defect-related communication post-sale.

Buyers are strongly encouraged to contact the Seller before purchase to verify any claims regarding condition, functionality, or warranty.

3. Manufacturer (OEM) Warranties

Some items, particularly new or surplus equipment, may still carry an original manufacturer’s warranty. However:

  • Constructionmarketplace.net makes no guarantee or representation that any such warranty is valid, active, or transferable.
  • It is the Buyer’s sole responsibility to confirm the existence, scope, and transferability of any OEM warranty prior to purchasing.
  • The Marketplace is not responsible for filing, validating, or enforcing manufacturer warranty claims.

4. No Endorsement or Guarantee

Constructionmarketplace.net does not:

  • Endorse or guarantee the quality, performance, safety, or reliability of any item listed,
  • Inspect or verify items before sale,
  • Operate as a manufacturer, distributor, or service provider of the listed items.

We serve as a neutral venue for Buyers and Sellers to transact and do not assume liability for issues related to the condition or performance of goods sold.

5. Limitation of Liability

Under no circumstances shall Marketplace, its owners, affiliates, officers, agents, or employees be liable for:

  • Any direct, indirect, incidental, special, consequential, or punitive damages,
  • Loss of profits, revenue, or business opportunities,
  • Equipment failure, delay, or downtime,
  • Personal injury or property damage arising out of or relating to a purchased item.

This limitation applies even if we were advised of the possibility of such damages.

6. Buyer Due Diligence

Buyers are responsible for conducting all necessary due diligence before purchase, including but not limited to:

  • Requesting additional information or photos from the Seller,
  • Verifying dimensions, fit, compatibility, and certifications,
  • Confirming warranty status directly with the manufacturer.

All purchases are made at the Buyer’s own risk.

7. Final Sale Acknowledgment

Unless otherwise stated in writing by the Seller, all sales are final. Returns, refunds, or exchanges are not guaranteed and are subject to the individual Seller’s policy.

Equipment and Materials Safety Notices

The following Safety Notices apply to all purchases made through the “Marketplace, including purchases by U.S. domestic Buyers. These notices relate to potential health, environmental, and regulatory risks associated with certain construction-related materials, parts, tools, and equipment sold via the platform.

1. General Safety Disclaimer

All products sold through the Marketplace—including new, used, refurbished, and surplus materials or equipment—may contain or have been exposed to substances regulated by federal, state, or international laws. These may include (but are not limited to):

  • Lead, mercury, cadmium
  • Asbestos-containing materials
  • PCBs or residual oils
  • Silica dust or respirable particulates
  • Combustible or flammable substances
  • Corrosive chemicals, glues, solvents, sealants
  • Mechanical, electrical, or fire hazards due to age or use

IMPORTANT:
It is the Buyer’s sole responsibility to:

  • Assess and handle all purchased goods safely,
  • Comply with applicable safety, environmental, and disposal regulations,
  • Wear appropriate PPE (Personal Protective Equipment),
  • Ensure safe installation, operation, maintenance, and disposal in accordance with local laws and industry best practices.

2. California Proposition 65 Warning (Mandatory)

WARNING: CALIFORNIA RESIDENTS

Safety Data Sheets (SDS) may be requested by workplace purchasers in accordance with the Right to Know law.

Minnesota

4. Used & Surplus Equipment Hazard Warning

Used and surplus equipment may:

  • Lack modern safety features,
  • Contain residual hazardous substances (e.g., lubricants, fuel, rust inhibitors),
  • Have unknown service history or undocumented modifications.

WARNING: Improper use of such equipment may result in serious injury or death. It is the Buyer’s duty to:

  • Fully inspect all goods before use,
  • Follow manufacturer safety recommendations (if available),
  • Retain a qualified technician or engineer to certify safe operation when necessary.

5. No Certification or Guarantee of Safety

Constructionmarketplace.net does not certify, test, or warrant the safety, usability, compliance, or hazard status of any item listed. We do not remove hazardous components or conduct inspections. All goods are sold as-is, and risk of use, resale, handling, or disposal rests solely with the Buyer.

Fee Schedule

Effective Date: August 19th, 2025
This Fee Schedule outlines the costs associated with selling goods, purchasing services, and participating in transactions through Constructionmarketplace.net (the “Marketplace”). Fees help support platform infrastructure, marketing, support services, fraud protection, and continuous improvement of our ecosystem.

All fees are quoted in U.S. dollars unless otherwise stated.

    3. Refunds and Adjustments

  • Refunded transactions will have Marketplace commissions and payment fees reversed, unless the refund is due to a policy violation or Seller error, in which case the Seller is responsible for all costs associated with the transaction.
  • Chargebacks may incur a $[15.00] dispute handling fee if not resolved amicably between parties.
  • Dispute mediation is offered for both the Buyers and Sellers of goods through the following **Dispute Resolution – Mediation Process**
  • In the event of any dispute, claim, or controversy arising out of or relating to your use of this website, the services provided, or these Terms and Conditions, the parties agree to first attempt to resolve the matter through good-faith negotiations. If the dispute cannot be resolved informally, the parties agree to submit the matter to confidential mediation administered by a neutral third-party mediation service located in the State of Arizona.
  • The mediation shall be conducted in accordance with the rules and procedures of the selected mediation provider, and shall take place in Maricopa County, Arizona, unless otherwise agreed in writing by both parties. Each party shall bear its own costs associated with the mediation, and the parties shall share equally the fees of the mediator.
  • Participation in mediation is a condition precedent to initiating any legal action or arbitration. Nothing in this clause shall prevent either party from seeking injunctive or equitable relief in a court of competent jurisdiction to prevent immediate and irreparable harm.
  • This clause shall be interpreted and enforced in accordance with applicable laws of the United States and the State of Arizona, without regard to conflict of law principles.

    5. Fee Changes & Notice

Marketplace reserves the right to update this Fee Schedule at any time. Notice will be provided via email or platform notification at least 15 days in advance for any material changes. Continued use of the Marketplace after such updates constitutes acceptance of the new terms.

Resolution Center Policy and Procedure

At Construction Marketplace, we strive to provide a trustworthy platform where Buyers and Sellers can transact safely and confidently. However, we understand that disputes may occasionally arise. Our Resolution Center is available to assist both parties in resolving transaction-related issues in a fair, timely, and professional manner.

1. What Issues Qualify for Resolution Center Review?

The Resolution Center accepts cases related to the following:

For Buyers:

  • Item not received
  • Item significantly different than described
  • Wrong item received
  • Missing parts or quantities

For Sellers:

  • Fraudulent chargeback or false dispute
  • Abuse of return policies or threats
  • Buyer refuses delivery or abandons shipment

Note: Disputes related to OEM warranties, operational failures due to misuse, or dissatisfaction with used/surplus item condition not clearly represented are not eligible for Marketplace mediation.

2. Before Filing a Case

We encourage Buyers and Sellers to attempt to resolve the issue directly via the Marketplace messaging system. Open communication is often the fastest and most effective way to clear up misunderstandings.

You must wait 24 hours after initial contact attempts before submitting a Resolution Center request, unless:

  • The item has not shipped within the agreed timeframe, or
  • The item was delivered and is damaged or incorrect.

3. How to File a Case

To initiate a Resolution Center case, follow these steps:

Step 1: Log in to Your Account

Visit Constructionmarketplace.net and navigate to “My Orders” or “My Sales” (depending on your role).

Step 2: Open the Resolution Center

Click on the order in question and select “Request Help” or “Open a Case”.

Step 3: Submit Required Information

You will be prompted to include:

  • Order ID and item(s) in question
  • Clear description of the issue
  • Relevant documentation (e.g., photos, shipping records, damage evidence, invoices)

Step 4: Submit the Request

Once submitted, you’ll receive a confirmation email with your case number.

5. Possible Outcomes

Depending on the nature of the dispute and the evidence provided, the Marketplace may recommend:

  • A partial or full refund to the Buyer
  • A replacement shipment or exchange (if available)
  • Return of the item to the Seller (at Buyer or Seller expense)
  • Dismissal of the case due to insufficient evidence or policy compliance

Note: The Marketplace is not a judicial authority and acts as a facilitator of resolution, not an arbitrator. Final decisions regarding refunds or returns ultimately rest with the Seller unless a violation of Marketplace policy is confirmed.

6. Non-Cooperative Parties

Failure to respond to a case in a timely or professional manner may result in:

  • Automatic case closure in favor of the other party
  • Account suspension or removal
  • Withholding of payouts or commissions (for Sellers)

We reserve the right to restrict Marketplace access for users who abuse the dispute process.

7. Resolution Center Limitations

The Resolution Center does not cover:

  • Buyer’s remorse or incorrect orders placed by mistake
  • OEM warranty claims
  • Damage or failure resulting from improper installation or use
  • Transactions completed outside the Marketplace

8. Dispute Resolution – Beyond Mediation
We are committed to resolving concerns quickly, fairly, and with minimal disruption. Most issues can be resolved through open communication or mediation. If that doesn’t work, we follow a clear escalation process:

1. Mediation
We will work with you and a neutral, independent mediator to seek a fair and mutually acceptable solution.

2. Arbitration
If mediation does not resolve the matter, the dispute will be decided by binding
arbitration administered by the American Arbitration Association (AAA) in accordance with its applicable rules.

Arbitration Terms:

  • Location: Phoenix, Arizona (unless both parties agree otherwise)
  • Language: English
  • Arbitrator: One (1), unless otherwise agreed in writing
  • Governing Law: The laws of the State of Arizona, excluding conflict‑of‑law principles
  • Decision: The arbitrator’s decision will be final and binding, and may be
    enforced in any court of competent jurisdiction

Costs:
Each party will bear its own costs unless the arbitrator decides otherwise

3. Court Action
If arbitration is not legally enforceable or does not resolve the matter, either party may bring the dispute before a court of competent jurisdiction.

Exceptions
This process does not prevent either party from seeking urgent injunctive or equitable relief in court to protect intellectual property rights or prevent actual or threatened infringement, misappropriation, or violation.
